These Terms of Service (“Terms”) govern access to and use of the website and online store available at glitzandgraf.com, together with any related services, features, content, and functionality (collectively, the “Services”).
The Services are operated by GLITZ&GRAF AGENCY SRL, Calea Moșilor 88, Sc. F, Ap. F1, Sector 3, 030152, Bucharest, Romania, Trade Register No. J2024001076400, Fiscal Identification Code (CUI): 49445834, EU VAT number: RO49624287 (“GLITZ&GRAF”, “we”, “us”, or “our”).
Our store is hosted on Shopify, and many of our products are made to order and fulfilled through third-party production and logistics partners.
By accessing the Site or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms.
You must be at least the age of majority in your place of residence, or have the involvement and consent of a parent or legal guardian, to use the Services.
You agree to use the Services only for lawful purposes and in compliance with these Terms and all applicable laws.
If you do not agree to these Terms, you must not use the Services.
3.1 Account and order information. You agree to provide accurate, complete, and up-to-date information, including your name, email address, billing information, and shipping details.
3.2 Order submission. When you place an order, you make an offer to purchase the selected products. We reserve the right to accept, reject, limit, or cancel any order, including in cases of suspected fraud, pricing errors, product description errors, payment issues, or unusual order activity.
3.3 Pricing and currency. Prices, currency displays, and product availability may vary by market. The price and currency shown at checkout at the time of purchase apply to your order.
3.4 Taxes and duties. Unless stated otherwise at checkout, prices do not include customs duties, import taxes, brokerage charges, or similar fees that may apply to international orders. Such amounts are the customer’s responsibility.
3.5 Payment. By submitting an order, you authorize us and our payment service providers to charge your selected payment method for the total amount due, including product price, shipping, taxes, and any other charges disclosed at checkout. Orders will not enter production until payment has been successfully authorized.
Many of our products are produced only after an order is placed using print-on-demand (“POD”) processes. Depending on the product, this may include custom printing, embroidery, or other made-to-order production methods.
Because products are made to order, minor variations in color, print placement, embroidery placement, garment texture, or size within normal manufacturing tolerances may occur and do not automatically constitute defects.
Products may be manufactured, packed, and shipped by third-party fulfilment partners located domestically or internationally. This may affect shipping origin, delivery timelines, tracking, and customs handling.
We make reasonable efforts to display product descriptions, colors, and images accurately, but actual appearance may vary depending on device display settings and production tolerances.
Shipping options, delivery estimates, shipping fees, and related conditions are described in our Shipping & Delivery Policy, which forms part of these Terms.
Production and transit times are estimates only and are not guaranteed unless expressly stated otherwise.
Unless mandatory law provides otherwise, risk of loss passes to the customer upon delivery of the order to the carrier or, where applicable, upon delivery to the address or pickup point designated by the customer.
We are not responsible for delays caused by carriers, customs, weather, force majeure events, or other circumstances outside our reasonable control.
Your rights and the procedures applicable to returns, refunds, defect claims, and withdrawal rights are set out in our Refund & Return Policy, which forms part of these Terms.
Because many of our products are made to order and may be personalized, certain items may not be eligible for cancellation or withdrawal where an exception is permitted by applicable consumer law.
Nothing in these Terms limits any mandatory statutory rights you may have as a consumer, including rights relating to defective or non-conforming goods.
From time to time, we may offer promotions, discount codes, shipping incentives, store credits, or gift cards. Such offers are subject to their stated conditions, including validity periods, territorial restrictions, usage limits, and product exclusions.
Unless expressly stated otherwise, promotions may not be combined and may not apply to gift cards, taxes, duties, or third-party charges.
We reserve the right to cancel, refuse, or adjust promotional benefits granted due to technical error, misuse, fraud, or breach of the applicable promotion terms.
You must not use the Services in any way that is unlawful, abusive, fraudulent, harmful, or intended to interfere with the Site or other users.

You may not copy, reproduce, distribute, modify, resell, publish, create derivative works from, or otherwise exploit any part of the Services or our content without our prior written consent.
If you submit reviews, comments, feedback, photos, or other content to us or through the Services (“User Content”), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display, adapt, and distribute such content for the purpose of operating, improving, and promoting the Services.
You represent that you have the rights necessary to submit the User Content and that it does not violate any law or third-party right.
We reserve the right, but not the obligation, to remove or refuse User Content at our discretion.
The Services may rely on or link to third-party platforms, payment processors, carriers, fulfilment partners, social media services, analytics tools, or external websites.
We do not control those third-party services and are not responsible for their content, availability, acts, omissions, or policies. Your use of such third-party services may be subject to their own terms and privacy policies.
To the fullest extent permitted by law, the Services and all content and products made available through them are provided on an “as is” and “as available” basis.
We do not guarantee that the Services will always be uninterrupted, secure, error-free, or available at all times, or that defects will always be corrected immediately.
Nothing in these Terms excludes or limits any warranty, guarantee, or statutory protection that cannot lawfully be excluded under applicable consumer law.
To the fullest extent permitted by law, GLITZ&GRAF and its affiliates, officers, directors, employees, contractors, agents, licensors, service providers, and fulfilment partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of revenue, loss of goodwill, loss of data, or business interruption, arising out of or in connection with the Services or any products purchased through the Site.
Where liability cannot be fully excluded, our total liability shall be limited to the amount paid by you for the specific product or order giving rise to the claim.
Nothing in these Terms excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot be excluded or limited under applicable law.
To the extent permitted by law, you agree to indemnify and hold harmless GLITZ&GRAF and its affiliates, officers, directors, employees, contractors, agents, licensors, suppliers, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of or related to your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.
We may suspend, restrict, or terminate your access to the Services where reasonably necessary to protect the Site, comply with law, investigate suspected fraud or misuse, or enforce these Terms.
Termination or suspension does not affect rights and obligations that by their nature should continue after termination, including provisions relating to payment, intellectual property, liability, disclaimers, indemnity, and dispute resolution.
These Terms are governed by the laws of Romania, without prejudice to any mandatory consumer protections that apply under the law of your country of residence.
If you are a consumer, nothing in these Terms deprives you of rights that cannot be waived or limited under applicable law.
Where legally permitted, disputes shall be subject to the jurisdiction of the competent Romanian courts. This does not affect any rights you may have to bring claims before the courts of your place of residence where mandatory law provides otherwise.
Consumers in the EU may also have access to alternative dispute resolution or other consumer redress mechanisms available under applicable law.
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, acts of government, war, terrorism, labor disputes, internet outages, utility failures, epidemics, carrier disruption, customs action, or third-party service outages.
18.1 Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, restructuring, or sale of assets.
18.2 No waiver. Our failure or delay to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
18.3 Severability. If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18.4 Interpretation. Headings are for convenience only and do not affect interpretation. If these Terms are translated, the English version prevails unless mandatory law requires otherwise.
These Terms, together with any policies or documents expressly incorporated by reference, including our Refund & Return Policy, Shipping & Delivery Policy, and Privacy Policy, constitute the entire agreement between you and GLITZ&GRAF regarding the Services and supersede prior understandings relating to the same subject matter.
